General Summary

The Office of Public Counsel has a full-time attorney vacancy. This position provides legal representation for the people of the State of Florida in proceedings related to electric, gas, water and wastewater utilities before the Florida Public Service Commission and in proceedings before counties pursuant to Section 367.171(8), F.S. This position also handles appeals from orders issued by the Florida Public Service Commission before the Florida First District Court of Appeal and the Florida Supreme Court.

Under the supervision of the Public Counsel and Deputy Public Counsel, this position applies his or her legal expertise to handle complex regulatory utility litigation, to research federal and state utility issues, to conduct legal discovery, and to prepare legal pleadings and briefs. The attorney must be able to assimilate and analyze a variety of complex legislative and legal concepts relating to regulatory utility issues.

Examples of Work Performed

  • Handles administrative litigation before the Florida Public Service Commission and certain specified counties on utility matters relating to water and wastewater, electric and gas service.
  • Assists with legal research in evaluating state statutes and preparation of legal opinions on questions relating to utility issues.
  • Prepares and drafts routine pleadings, briefs, agreements, and related legal documents relating to utility issues.
  • Provides legal counsel on behalf of utility ratepayers on legal matters related to utility matters that come before the Florida Public Service Commission; interprets state and federal legislation related to utility matters.
  • Performs legal research concerning the interpretation of Florida Statutes and The Florida Administrate Code on other utility matters in question.
  • Performs other related duties as required.
  • Litigate before Appellate Courts.

Minimum Qualifications

Attorney in good standing with The Florida Bar and two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.

Preferred Qualifications

Experience in federal, state and/or local government regulatory utility matters.

Experience in regulatory litigation.

Salary

$52,632 – $105,576 annual salary.
