Summary

Provide technical and strategic counsel on a broad range of legal, compliance, underwriting, product development, agency, and distribution issues for Personal Lines and Commercial Lines, including NFIP Flood, business operations for Selective’s nine admitted companies and one excess and surplus lines company. Manage and mentor a team of professionals including Corporate Counsel and Products and Compliance Specialist to further business initiatives and individual development. Counsel clients on industry emerging risks, developments in statutory and case law and regulatory changes affecting our business. Align with Government Affairs, along with regional and national trade associations, on industry issues to inform policy and regulations and draft appropriate legislation. All job duties and responsibilities must be carried out in compliance with applicable legal and regulatory requirements.

Essential Functions

  • Provides timely and appropriate legal advice and counsel on underwriting, compliance, product development and policy forms, and pricing issues to our three insurance segments to ensure policy forms meet underwriting and actuarial intent and are fully compliant with applicable laws and regulations for admitted and non-admitted companies.
  • Maintains knowledge of industry issues and our coverages to assist underwriters and agents with understanding Selective’s competitive position and address with ad hoc hypothetical questions about coverage.
  • Maintains knowledge of and serves as subject matter expert to clients and Government Affairs on high profile legal issues and exposures including emerging issues such as Abuse-Statutes of Limitations and Reviver Window Legislation, Cannabis Legislation and Liability, Geographic Expansion, construction defects, priority of coverage, anti-stacking/non-accumulation clauses, additional insured status, liability caps, and sovereign immunity.
  • Provides timely and appropriate legal advice to the Compliance and State Filings areas, particularly department of insurance inquiries and consumer and executive complaints.
  • Provides timely and appropriate legal advice and counsel on agency and licensure issues, including compensation, for our agency partners.
  • Provides timely and appropriate legal advice and counsel to NFIP Flood Operations, including close collaboration with Government Affairs on reauthorization issues.
  • Align with Government Affairs, along with regional and national trade associations, on industry issues to inform policy and regulations and draft appropriate legislation.
  • Responsible for correspondence form library to ensure that underwriting communications with policyholders and agents are in Plain English, meet policy and regulatory requirements, and further enhance the customer experience.
  • As requested, provides training to the regional and corporate underwriting and/or claims departments on matters of legal interest.
  • Fosters a sense of collaboration, partnership and communication to achieve departmental and enterprise goals. Believes the team is more powerful than the individual. Supports organizational and departmental transitions throughout the year, continues to develop to a cohesive team, and drives mentoring and leadership and subject matter development plans for self and those reporting into you.

Knowledge & Requirements

  • Good understanding of property casualty insurance and coverage legal issues.
  • Able to process information quickly and propose workable solutions.
  • Strong written and verbal communication skills and the ability to make complex legal concepts clear to non-lawyers.
  • Excellent analytical skills.
  • Proven track record of earning and keeping the trust of clients and colleagues.

Education & Experience

  • Juris Doctor (JD) degree required.
  • Minimum of 10 years of experience practicing law with an extensive background providing insurance regulatory and coverage advice to insureds or an insurance carrier.
  • 5+ years prior management experience.
  • Regulatory or litigation experience preferred.
  • Licensed to practice law in at least one US jurisdiction, preferably NJ or NY, and eligibility for NJ in-house counsel limited license.

Salary Range: $146,100- $241,100. The actual base salary is based on geographic location, and the range is representative of salaries for this role throughout Selective’s footprint. Additional considerations include the candidate’s qualifications and experience.
