The Senior Manager, Compliance will be responsible for ongoing implementation, monitoring, and maintenance of Nestle Health Science’s Corporate and Healthcare Compliance Programs, including an independent and collaborative leadership role throughout the organization.
PRIMARY RESPONSIBILITIES:
Overseeing and monitoring the implementation, operation and maintenance of NHSC’s Healthcare Compliance Program:
- Advising the business on Sales and Marketing activities, customer and HCP contracts, pricing arrangements, Medical Affairs and Market Access projects, and other areas which may have healthcare compliance implications.
- Reviewing new business initiatives to ensure that these arrangements comply with applicable laws, regulations and NHSc Healthcare Compliance Program.
- Modifying NHSc’s Healthcare Compliance Program (including the Compliance Policies, Standard Operating Procedure, and compliance guidance and SOPs), as needed to address new compliance risk areas arising from new products, new business initiatives, or changes or updates to applicable legal and regulatory requirements.
- Implementing federal Sunshine Act and state aggregate spend reporting at times when the company is considered an applicable manufacturer
- Developing and delivering NHSc’s annual and ad hoc healthcare compliance-related education and training programs.
- Overseeing implementation of Healthcare Compliance requirements including working with Human Resources to ensure proper screening for applicable employees and contractors.
- Being responsible for the Educational and Research Grants process, including creating and managing the budget, acting as Chair of the Grants Committee.
- Developing and maintaining effective lines of communication, embodying an open-door culture and overseeing a robust disclosure program including an anonymous hotline.
- Conducting internal monitoring and auditing on an ongoing basis to assess compliance with NHSc’s Healthcare Compliance Program.
- Investigating reported or suspected violations of applicable laws, regulations or policies and taking corrective action where appropriate.
- Monitoring Patient Assistance Program, including making sure that the Program is consistent with applicable laws, creating and managing the budget, and determining the program guidelines
Developing and overseeing NHSc’s compliance with applicable laws, rules, and regulations.
- Overseeing activities necessary to ensure employee adherence to Nestle’s Corporate Code of Conduct and Conflicts of Interest Policies, including providing training and reviewing reported potential conflicts of interest.
- Coordinating a compliance program to assess and addresses primary areas of compliance risk through a Corporate Compliance Committee, acting as Corporate Compliance Committee Chairperson.
- Developing and delivering training in corporate compliance subject areas such as ethics, fraud, bribery, and conflicts of interest, leveraging Nestle resources
- Coordinating and implementing compliance initiatives and training required by Nestlé Global Compliance/Legal.
- Demonstrate commitment to the goals and core values of the company.
EXPERIENCE AND EDUCATION REQUIREMENTS
- Healthcare Compliance Certificate (i.e., CHC or CHPO) is required
- Five (5) to ten (10) years of experience is required in a legal, regulatory, or compliance position(s).
- Experience in developing and implementing policies that ensure company compliance with the False Claims Act and Anti-kickback Statute is strongly desired.
- Experience with healthcare products, preferably Medical Foods, but could be medical devices, and/or drugs, is strongly desired.
- Experience in writing of policies and SOPs, and creation and delivery of training is strongly desired
- Advanced Degree (i.e., MBA, Masters of Healthcare Administration) preferred
- Experience in contract construction and review is strongly desired.
- Experience with Marketing/Sales literature/promotional review and approval is a plus.
