Under general supervision of the Managing Attorney, provides paralegal support which includes legal research and the preparation of legal pleadings, discovery documents, and trial notebooks. This job class is treated as FLSA Non-Exempt.
Essential Functions: (Essential functions may vary among positions, but may include the following tasks, knowledge, abilities, skills, and other characteristics. Examples of Tasks
1. Researches a variety of legal problems by locating applicable precedents, legal opinions, statutes, and orders, using hard copy, databases, and specialized legal research tools such as Westlaw and/or FindLaw.
2. Analyzes, appraises and organizes facts and evidence; obtains additional information by telephone or letter; and presents material in a concise and logical manner.
3. Serves as an in-house resource on the use of database and legal research software; researches available software; maintains/updates proficiency in the use of the job related software.
4. Keys or types a variety of documents (e.g., letters, discovery documents, agreements, pleadings, motions, and briefs) from clear copy, rough draft, or required legal format, for review and final approval by the attorney.
5. Reviews, organizes, and indexes pleadings, discoveries and other pertinent legal documents for litigation files. Assembles trial notebooks.
6. Deals tactfully and courteously with the public, including community members making consumer complaints or requesting service, both in person and by telephone; independently responds orally or in writing to routine requests for information; explains Legal Services policies and procedures. Maintains sensitive and confidential information and records.
7. Prepares pleadings, motions, discovery documents, and trial notebooks.
8. Reviews files in a timely manner for the presence of appropriate documents. Responds to discovery requests; updates disclosure as additional evidence or documents are located. Organizes and reviews trial files.
9. Attends and participates in legal education and training courses in order to gain and/or retain proficiency in job related matters.
10. Receives, logs in, files, disseminates, and/or mails documents.
Knowledge, Skills, Abilities, and Other Characteristics:
- Knowledge of law office management practices and procedures, including computer law office systems.
- Knowledge of the formats used for a variety of pleadings, discovery documents, trial notebooks.
- Knowledge of consumer law, personal injury, Chapter 7 and Chapter 13 bankruptcy filings, civil or family law.
- Knowledge of the history, culture, laws, rules, customs and traditions of the Salt River Pima-Maricopa Indian Community.
- Knowledge of the procedures of legal research, including the using of specialized legal databases such as Westlaw.
- Knowledge of technical legal medical terms and various legal forms/documents and procedures in litigation and federal bankruptcy procedures.
- Knowledge of legal documents sufficient to complete them from scratch, using appropriate computer software under the supervision of an attorney.
- Knowledge and proficiency with state and federal rules of civil procedure.
- Knowledge in various areas of law such as Family, Probate, Consumer, Bankruptcy and Personal Injury preferred but not necessary.
- Skill in establishing and maintaining effective working relationships with other staff and the clients and/or other law offices.
- Skill in listening well, and communicating effectively with Community members and employees having varying educational backgrounds and values.
- Skill in identifying and maintaining the confidentiality of sensitive and important information while using diplomacy and tact.
- Skill in operating a variety of standard office equipment which may include a photocopier, fax machine, typewriter, multi-line telephone, and a personal computer.
- Skill in using job related software, including the database Westlaw and internet sites such as FindLaw.
- Skill in typing/keyboarding 60 wpm net.
- Skill in using law office management system software.
- Ability to understand and follow oral and written instructions which may entail procedural or technical detail.
- Ability to adapt to changing work situations and assignments.
- Ability to prioritize and meet changing deadlines.
- Ability to use initiative and independent judgment, while at the same time recognizing when it is appropriate to refer matters to the supervisor’s attention.
Minimum Qualifications
- Education & Experience: Requires an Associate’s Degree or certificate of completion from an accredited college or technical school as a Paralegal or Legal Assistant and two to four years of experience in a law office or legal setting under the direction of an attorney involving specifically delegated legal work. Word processing skills and experience with personal computer software database applications such as Westlaw is highly desirable. Completion of a college level paralegal training program with certificate may be substituted for one year of paralegal experience.
- Equivalency: Any equivalent combination of experience and education that will allow the applicant to satisfactorily perform the duties of the job may be considered when filling the position.
- Underfill Eligibility: An enrolled Community Member whom closely qualifies for the minimum qualifications for a position may be considered for employment under SRPMIC Policy 2-19, Underfill.
