Job Summary
Under general direction of the County Treasurer (elected official), this position administers the Public Trustee function, as well as performs treasurer related duties as needed. This role is responsible for following the Colorado state statutes, primarily in CRS Title 38, CRS Title 39 and CRS Title 30, as well as others associated with the Public Trustee and Treasurer functions. The person in this role must exercise initiative and independent judgment in all assigned functions and tasks, as well as exemplify the values of accountability, integrity and respect. Essential Job Functions
Essential functions may include any of the following tasks, knowledge, skills and other characteristics. Assists the public, title company employees, mortgage, escrow and bank employees, as well as attorneys in person, on the phone, via e-mail, or regular mail.
Processes releases of deeds of trust in person, through the mail and via email. Researches and signs legal documents, collecting any public trustee funds due; works to resolve difficult and emotional situations. Ensures all statutory documents are included in the files. Ensures compliance with state-mandated reporting and processing deadlines.
Responsible for the entire foreclosure process, including processing releases of deeds of trust and bankruptcies, following the statutes in Title 38. Must be able to interpret complex foreclosure issues such as bankruptcies, junior lienors, legal obligations, etc.
Responds to attorneys’ verbal and written requests on legal and technical subjects related to the foreclosure process and documentation needs. Must be able to research and cite statutes.
Responds to customer requests for information and documentation of the foreclosure process and on curing foreclosures.
Maintains accounting records associated with releases of deeds of trust and foreclosures. Ensures accurate reporting of these statistics.
Maintains the public trustee website with respect to foreclosure auctions.
Conducts foreclosure auctions in accordance with state statutes.
Assists Treasurer with Treasurer Deed process.
Assures that assigned accounts/activities are processed, recorded and filed accurately and in a timely manner. This involves researching and compiling information, notifying affected individuals of action, collecting fines or fees.
Interacts with others outside one’s own office to exchange appropriate information regarding balances, warrants processed, records, or other related information; provides advice, solves problems, and maintains cooperative and efficient relations needed to perform duties.
Balances out cash, checks and other receipted funds on a daily basis. Reviews summary reports with the Treasurer. May serve as back up for funds receipting during high volume periods.
Creates back up documentation for treasurer and public trustee disbursements.
Keeps Treasurer informed of issues and potential issues arising in the office.
Miscellaneous:
Performs those day-to-day activities that are required to keep the department functioning effectively, but are not specifically related to assignment.
Performs other related duties as required.
Minimum Qualifications Required
Any combination of education and experience that would likely provide the required knowledge, skills and abilities is qualifying. A typical way to obtain the knowledge, skills and abilities for this position would be:
Education and Experience: High school graduate or GED. Some coursework in accounting, bookkeeping, tax, title research or related business courses. At least three years’ experience in a public trustee office, title company or related field dealing with real estate.
