Summary

The Vice President of Contracting Services will oversee Vendor Performance and direct the activities of a business unit responsible for conducting in-depth research, analysis, background reviews, and investigations concerning contractors, consultants, and suppliers’ business integrity, ethics, and overall performance to facilitate informed responsibility determinations. The position will support executive management with executing core responsibilities and activities within the Contracts Department. This position will also provide status updates to executive leadership, as required.

Responsibilities

Reviews and approves contractor and consultants’ responsibility status and remains current with trends necessary to provide quality deliverables.

Responsible for convening and chairing special responsibility hearings with senior executives representing various national and international companies to examine issues involving organizational integrity and performance on prior and existing projects.

Conducts in-depth background investigations leveraging internal and external databases capturing contractor, consultant (subcontractor, and sub-consultant) performance data.

Responsible for developing and updating policies, procedures, and guidelines for assessing contractor responsibility.

Research, review, evaluate, and analyze complicated court rulings, civil and criminal judgments, and other legal and business material to draft recommendations on awarding contracts, notwithstanding significant adverse information.

Oversees the filing of necessary documentation related to past and present vendor performance matters to promote the efficient operation of the Contracts Department.

Drafts, edits, and/or otherwise contributes to reports generated for MTA agency executives and senior staff on matters related to delivering the MTA’s Capital Program.

Understands and enforces compliance with all applicable laws, regulations, and policies related to vendor performance.

Reviews and approves staff decisions on vendor performance matters.

Ensures that vendor performance corrective actions are executed according to plan.

Collaborates with other MTA agencies on vendor performance matters for efficient and quick resolutions.

Manages priorities, assignments, and the division’s output to enhance procurement timelines.

Possesses the ability to communicate with multiple and various audiences.

Directly interfaces with MTA Audit, the MTA Inspector General’s Office, the New York State Comptroller’s Office, and other external groups conducting investigations of vendor activities.

Education and Experience

Bachelor’s Degree in Business Administration, Public Administration, Engineering, Finance, Law, Government Contracting, or a related field.

Masters or JD preferred.

Must have a minimum of sixteen (16) years of related experience in contracts and procurement.

Must have at least ten (10) years’ experience in a management or supervisory role, including significant experience working on matters involving compliance, public works projects, construction projects and/or public sector procurement management principles, and government project administration.

An equivalent combination of education and experience may be considered.

Competencies:

Significant experience working with public sector procurement management principles, government project administration, and bidding processes.

Significant experience working on vendor performance matters on public works projects, construction projects, and/or real estate matters.

Substantial experience with internal, external, and online tools and systems necessary for vendor research.

Experience using and applying contract terminology, terms and conditions, and procurement construction management language.

Experience with relevant local, state, and federal laws, including federal and state procurement laws, rules, and regulations.

Ability to multi-task and work cooperatively and effectively with stakeholders, executive management, board members, elected officials, and other stakeholders in a fast-paced environment and ensure favorable outcomes for the agency.

Excellent interpersonal, analytical, problem-solving, organizational, negotiation, and communication skills.

Ability to comprehend, analyze, and interpret complex business documents.

Demonstrated ability to work in a high-profile, high-pressure environment effectively, working cooperatively and effectively with stakeholders, executive management, and board members.

Excellent judgment and ability to work independently on matters of significant size and complexity.

Proven leader as a change agent and creative/innovative thinker with the ability to align business goals with solutions and drive process improvements.

Advanced knowledge and use of Microsoft Office Suite and document management software.
