Agency Attorney Level II

The Legal Bureau provides legal guidance to the Police Department and is responsible for advising all members of the Department on all legal matters affecting the Department, including major civil litigation and important judicial developments. The Bureau monitors and facilitates the relationship between the Department and the rest of the criminal justice system and assists members of the service in interpreting and enforcing state, federal, and local laws; ensures that the practices of the department are lawful and are fairly applied; and develops legislation in accordance with the need of the Department and public safety concerns.

The NYPD’s Hate Crimes Unit is responsible for providing a coordinated police response to, as well as a thorough investigation and analysis of, all bias-motivated incidents. Pursuant to a three-year grant awarded by the U.S. Department of Justice, the NYPD Legal Bureau is seeking an Agency Attorney II to serve as its direct liaison to the Hate Crimes Unit.

As the Legal Bureau’s liaison to the Hate Crimes Unit, the Agency Attorney will:
– Assist investigators in bringing the strongest prosecutable case to the five (5) District Attorney’s Offices and to the federal prosecutors and liaise with other City agencies.
– Conduct legal research to determine whether certain actions can be prosecuted on a state or federal level.
– Confer with the Commanding Officer, Hate Crimes Unit to ensure proper resolution of complaints, and, where appropriate, make referrals outside of the agency.

Minimum Qual Requirements

1. Admission to the New York State Bar; and either “2” or “3” below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Preferred Skills
– Admission to the New York State Bar, with at least 3 or more years of criminal law practice in New York State. Trial room experience serving as a prosecutor or defense attorney is essential.
– Mastery of the New York State Penal Law, Criminal Procedure Law, NYC Administrative Code, and other relevant local, state, and federal criminal laws.
– Strong communication skills and the ability to clearly and practically convey complex legal topics to large groups.
– Demonstrated ability to manage a diverse, complex, and fast-evolving workload, while maintaining priorities and proactively anticipating issues.
– Ability to possess and maintain a NYS Driver’s License.

New York City residency is generally required within 90 days of appointment. However, City Employees in certain titles who have worked for the City for 2 continuous years may also be eligible to reside in Nassau, Suffolk, Putnam, Westchester, Rockland, or Orange County.
