Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.

Pay: $90,000 annually

Position Summary: This position is in the Civil Legal Services – Revenue Litigation Bureau.

Qualifications: Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

Preference will be given to candidates with either: (1) LLM in taxation; (2) civil litigation experience; (3) administrative litigation experience; and/or (4) appellate experience. A background in tax is helpful but not required.

The Work You Will Do:

The primary duty of the position is to represent the Florida Department of Revenue in litigation in the state courts and in the Division of Administrative Hearings. Cases involve matters related to tax assessments, refund claims, and ad valorem (property tax) issues statewide. The attorney may be assigned to cases both at the trial and appellate levels. At the trial level, the cases may be before a judge or an administrative law judge.

An Assistant Attorney General (“AAG”) is expected to research and draft pleadings, motions, discovery, memoranda, briefs, orders, and other documents. The attorney will also develop litigation strategy in conjunction with the client, prepare witnesses for depositions and trial, conduct discovery, and represent the client at trial or hearing.

The AAG will be expected to represent the Department in simple to medium-high complexity matters, and to co-counsel on more complex matters. This office relies on the experience and leadership of assistant attorneys general to provide guidance to the younger attorneys in the office.

The AAG is expected to continue to acquire expertise in state tax litigation, and to require less direct supervision over time and to take on increasingly complex cases. The incumbent may also occasionally be required to participate in short-term projects involving legal duties of this office in the representation of the State.

The AAG also performs administrative tasks, which may include the following: coordinating work assignments with co-counsel, administrative secretaries, paralegals, and interns; attending bureau staff meetings; preparing travel vouchers, time records and case status reports; filing documents, etc.
