MINIMUM QUALIFICATIONS:

Candidates must be admitted to the New York State Bar AND have three years of relevant, post-graduate experience, including significant trial work or administrative hearing experience, demonstrating progressively responsible experience in each area.

Duties Description The New York State Education Department’s (NYSED) Office of the Professions (OP) is seeking candidates for an Assistant Counsel position in the Office of Professional Discipline (OPD). Under the direction of the OPD management and a supervising attorney, the incumbent will participate in the development and review of legal documents, participate in the OPD disciplinary process, and provide oversight and legal guidance to other attorneys and support staff. Duties of this position include, but are not limited to, the following:
• Provide legal advice to OPD investigators and members of the various State boards for the professions;
• Participate in the professional misconduct legal process, including engaging in settlement negotiations in professional misconduct cases and drafting relevant settlement documents;
• Prepare for hearings and try before panels of the various state boards professional misconduct cases, moral character cases involving individuals seeking licensure, and restoration of license cases involving individuals whose licenses have been previously revoked or surrendered;
• Represent OPD before the Regents Review Committee, which reviews decisions of hearing panels in professional misconduct cases;
• Research and prepare well-written briefs, memoranda of law, specifications of professional misconduct, other legal pleadings, internal memoranda, and correspondence;
• Ensure the effective and timely management of all caseloads, assisting in the training and guidance of attorneys in the downstate offices of the OPD, predominantly in the areas of serious or complex misconduct by licensed professionals and under supervisory direction, assist in the supervision of other OPD prosecutors as needed;
• Interact courteously and effectively with members of the Board of Regents and the various State professional boards, other SED staff, opposing counsel, witnesses, and members of the public; and
• Perform various legal, administrative and management responsibilities throughout the OPD.

Additional Comments CONDITIONS OF EMPLOYMENT: This position is in the exempt class and the incumbent will serve at the discretion of the Commissioner of Education. Salary will be commensurate with education and experience. Promotions and transfers may change appointees’ negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. This position will require frequent same-day travel and occasional overnight state-wide travel. Filling of this position is contingent upon Division of the Budget approval.

Based on this position’s location, in addition to the listed base salary, this position also receives a $3,026 Downstate Adjustment.
