Job Responsibilities
Under limited supervision, serves as a senior attorney to provide legal advice and counsel to boards and program areas for the Agency in a variety of different meetings, hearings, and forums.
Advises and counsels professional licensing board members, agency staff, and agency senior leadership regarding professional and occupational licensing and other agency programs. Serves as a senior attorney and subject matter consultant to identify issues and understand and interpret the practice acts, legislation, regulations, rules, and procedures to provide recommendations for resolution. Attends all board meetings, committee meetings, hearings, and other meetings, to provide advice and legal counsel during the conduct of the meeting. Conducts legal research and provides legal advice on written and oral motions, evidentiary matters or objections, hearing procedures and processes, statutory interpretation, and other advice prior to the board or committee rendering a decision. Drafts orders, directives, and/or other documentation related to board decisions and application hearings, including denials, restrictions, or conditions on licensure in accordance with applicable laws and findings.
Researches and stays abreast of relevant legal issues that affect licensing and current administrative law cases, court of appeals cases, and Supreme Court cases to advise and update applicable stakeholders. Provides updates to boards and commissions on national and state legal trends. Identifies legal issues that could impact the agency, boards, commissions, and/or committees and provides advice and counsel regarding those issues. Provides general advice to agency personnel, including board administrators, the Agency Director, and Deputy Directors regarding administration of the boards.
Assists the Office of Communications and Governmental Affairs (OCGA) with tracking the development of state and federal laws, regulations, advisory opinions, and/or judicial decisions that affect professional and occupational licensing and other agency programs. Researches the impacts of proposed legislation on licensing board practice acts and assists with the implementation of new laws, regulations, or programs. Assists with drafting regulations and implementing legislation in conjunction with the boards. Assists OCGA with responding to FOIA requests, media inquiries, releasing information, and interpreting practice acts related to confidentiality.
Reviews, edits, and approves board and committee meeting materials (including agendas) prior to meetings and materials (including minutes) after the meeting. Researches, drafts, edits, and reviews legal advisory memoranda, policies, procedures, opinions, and communications to assist board members and Agency staff in interpreting and applying statutes in compliance with board practice acts and regulations, the Freedom of Information Act, the Administrative Procedures Act, the S.C. Ethics Act, Rules of Evidence, South Carolina Attorney General Opinions and other applicable provisions of law.
Creates and conducts training for board members and hearing officers on practice acts, procedural issues, evidentiary issues, and other legal-related issues necessary to perform hearings. Attends internal and external meetings as advice counsel and representative of the Agency and boards and commissions, as needed. Represents boards in appeals and state or federal court, as required. Represents the agency and/or board/program areas in meetings or special task force/committees. As necessary, learns, reviews, and prepares for other board practice acts to cover hearings or committees due to scheduling conflicts. Performs other duties and projects as assigned.
Minimum and Additional Requirements
State Minimum Requirements: A Juris Doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.
Knowledge of SC laws, Administrative Procedures Act, policies, standards and procedures of the AG’s office, general case, statutory and common law, judicial and quasi-judicial procedures and rules of guidance, knowledge of Agency structure, mission, programs, and objectives. Ability to interpret laws, analyze facts, evidence, and legal instruments, express conclusions and arguments clearly and logically, make presentations, and prepare reports. Ability to apply and explain laws and regulations of boards. Legal research and drafting of briefs, orders, and legal memoranda.
Under limited supervision, serves as a senior attorney and will have a broad range of independence and discretion. Must be self-motivated.
Occasional overnight travel and weekend assignments. The position is located in an office environment with long periods of sitting. May require occasional work outside of normal office hours.
Preferred Qualifications
Preferred Requirements: A Juris Doctor or its equivalent from an accredited law school and ten (10) years experience as a practicing attorney. Member of the SC Bar and completion of the Rule 403 requirements.
