Why does the job exist?
To handle criminal appeals on behalf of the State and, at times, its agents, in state and federal appellate courts.
How does it get done?
The Assistant Solicitor General will be responsible for representing the State and, at times, its agents, in criminal appeals in state and federal appellate courts, with the vast majority of our work being resolved in state appellate courts. This involves completely familiarizing oneself with the trial record and, as appropriate, discussing the case with state prosecutors; performing legal research; drafting appellate briefs; and engaging in moots and oral arguments as they arise. The position may also occasionally involve working on writs and expedited pretrial detention appeals, state habeas matters, and on the rare occasion, federal habeas matters. The position also involves aiding state prosecutors with appellate questions and strategy, potentially participating on state and national committees, presenting at conferences, and performing other criminal-appeals-related duties as directed by the Solicitor General.

The State of New Mexico and, occasionally, prosecutors and/or their offices and wardens.
Ideal Candidate
An ideal candidate has appellate experience and interest, the ability to research and write on complex criminal topics, and the ability to appear in appellate courts and, on occasion, trial courts, for oral argument or hearings related to the cases we handle.
Minimum Qualification
Juris Doctorate degree from an accredited school of law and five (5) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements
Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification as a condition of continued employment as some statewide travel maybe required. Employment requires successful completion of post offer pre-employment physical and is subject to criminal background check and is conditional pending results of criminal background check. Must be a citizen of the United States; be eighteen (18) years of age or older; be of good moral character and not have been convicted of a felony offense by a court of this state, any other state or the United States.
Working Conditions
Office setting, exposure to Visual/Video Display terminal (VDT) and extensive personal computer and telephone usage with extended periods of sitting, including during public meetings and hearings. Must be able to lift 25 lbs, and some sitting, standing, bending and reaching may be required. Travel will be required, including occasional overnight trips, and candidates must have or be able to obtain a New Mexico driver’s license in order to receive a certification to drive a state vehicle upon employment.
