The mission of the Colorado Energy & Carbon Management Commission (ECMC) is to regulate the development and production of the natural resources of oil and gas in the state of Colorado in a manner that protects public health, safety, welfare, the environment and wildlife resources. Our agency seeks to serve, solicit participation from, and maintain working relationships with all those having an interest in Colorado’s oil and gas natural resources.

The Cumulative Impacts/Regulatory Affairs Unit leads the agency’s efforts regarding Cumulative Impacts and Environmental Justice, is responsible for the Director’s review and administrative approval of matters coming before the Energy and Carbon Management Commission (ECMC), has primary responsibility for Commission rulemaking processes, and works closely with the Attorney General’s office, which serves as counsel to the Commission, on legal matters and staff applications for hearing before the Commission.
Description of Job

Position Summary:
This is a new position authorized as a PSRS-V by HB23-1294. It is specifically tasked with developing and managing Cumulative Impacts associated with energy development. Because of the strategic relationship between Cumulative Impacts, Environmental Justice, and Regulatory Affairs, the position has been tasked with managing all Regulatory Affairs.
Cumulative Impacts Program
This position is tasked with developing and implementing programs and policy, and facilitating required rulemaking regarding the effective administration of cumulative impacts, including the concerns of environmental justice and the impacts of development on disproportionately impacted communities.
Help to develop regulatory and permitting processes for legal and technical aspects of establishing the Cumulative Impacts and Environmental Justice program. Includes:

  • Stakeholder engagement
  • Survey and coordinate with industry, EPA, other state agencies to determine what administrative framework is needed
  • Collaborate with appropriate outside agencies on program and process improvement, and pending development permits
  • Helping to establish needed agreements such as MOUs or MOAs
  • Regulatory review of other programs
  • Participate in drafting proposed rules
  • Provide guidance on processing hearing applications for development permits
  • Engage in outreach to disproportionately impacted communities
  • Engage with members of the regulated community on meeting cumulative impacts and environmental justice regulations
  • The position must routinely plan and host potentially contentious stakeholder engagements related to cumulative impacts, environmental justice, or impacts to disproportionately impacted communities and rely on their experience to effectively manage the engagement.
  • Data needed to effectively monitor cumulative impacts is not available. This position must identify what data is needed, develop a plan to obtain the data, and work with other agencies or ECMC Units to collect and maintain the data.
  • The Director requests a policy(ies) regarding a matter related to cumulative impacts. This position must rely on their knowledge and understanding of the regulatory landscape to develop the policy.
  • This position may help facilitate ECMC unit decisions that must meet regulatory policy for disproportionately impacted communities and cumulative impacts. The orphan well program has two abandoned locations, one that is within a disproportionally impacted community, and one that when added to existing industrial development in the area has a significant cumulative impact on nearby residents. This position provides guidance to the orphan well program on which location should be prioritized for plugging and abandonment.

Commission Liaison
Provide oversight of the staff authorities for variances and financial assurance plans, general interaction with the commissioners, stakeholder engagement on matters beyond cumulative impacts, and provide guidance to other Unit Managers regarding commission engagement.

  • A complicated variance application is submitted. Consult with the staff authority, PHA 019, to determine how best to review the application and considerations to be made in the development of a director’s recommendation.
  • A complicated financial assurance plan is submitted. Consult with the staff authority, PHA 24.12, to determine how best to review the plan and considerations to be made in the development of a notice of decision to approve or deny or development of a director’s recommendation.
  • The Commission is seeking input on a matter. This position will work with the Deputy Director for Policy & Administration to determine how best to engage.

  • The position must plan and host potentially contentious stakeholder engagements related to some new matter before the Commission, relying on their own abilities to effectively manage the meeting.

MINIMUM REQUIREMENTS:
Six (6) years of experience in an occupational field related to the work assigned to the position.
AND
Bachelor’s degree from an accredited institution in a field of study related to the work assignment.

SUBSTITUTIONS:

  • Additional appropriate experience will substitute for the degree requirement on a year-for-year basis.
  • Additional appropriate education will substitute for the required experience on a year-for-year basis.
