Responsibilities

Legal Counsel I & II:

  • Under the supervision and guidance of a supervising attorney, provides legal advice and handles legal matters in various areas of law as assigned, with an emphasis on Federal Government and commercial contracting and subcontracting and other agreements, Federal Freedom of Information Act and Privacy Act, other federal and state privacy laws, and regulations. Other areas of law which may be assigned include, but are not limited to: labor, employment, environmental, non-disclosure agreements, insurance, litigation, employee benefits/ERISA, investigations, regulatory compliance, export compliance, ethics, workers’ compensation, unemployment, corporate, real estate, tax law, occupational medicine, HIPPA, tort claims, or other areas.
  • Provides legal counsel and guidance to Company officials on various complex or important legal
  • Advises leaders and management on a broad range of corporate governance, regulatory and compliance matters, and provides a high-quality legal partnership to the business
  • Works to resolve various complex and important legal problems.
  • Manages litigation conducted by outside counsel in Federal or State Courts or appears on behalf of the company in Federal or State Court (as needed).
  • Prepares legal correspondence, pleadings, discovery documents, and motions and briefs relating to litigation and appellate matters.
  • Works to ensure operations remain within the limits prescribed by law and business contracts with the federal government.
  • Performs legal research and analysis in complex or important
  • Keeps abreast of industry-specific regulations, in particular,Department of Energy regulations and policies governing Managing and Operating Contractors and subcontracts.
  • Develops and disseminates policy and direction on legal aspects of operating activities for the guidance and control of operating divisions.

Qualifications

Legal Counsel I & II:

  • Legal Counsel I: Minimum Education and Experience: Juris Doctorate degree from an ABA-accredited lawschool, or any law school that is approved by the Nevada Supreme Court and up to 3 years’ experience in relevant area(s) of law with at least 3 years as a licensed attorney with a law firm, government agency, and/or corporate in-house legal department.
  • Legal Counsel II: Minimum Education and Experience: Juris Doctorate degree from an ABA-accredited law school, or any law school that is approved by the Nevada Supreme Court and at least 5 years’ experiencein relevant area(s) of law.Must have excellent writing, research, negotiation, and analytical
  • Must have passed a state bar examination and must be a member in good standing of that state’s
  • Must be eligible to become a member of the Nevada State Bar (or to be admitted to the Nevada State Bar as in-house counsel).
  • Must be willing to learn new areas of law and to take on new challenges.
  • Able to utilize independent judgment, creativity, and initiative and ability to apply knowledge and experience to resolve problems, compose correspondence and technical reports, and accomplish goals where established procedures may not be specific.
  • Able to prioritize and schedule multiple activities of the organizational
  • Must possess excellent oral and written communications
  • Must possess excellent interpersonal skills and ability to communicate with all types of people in a tactful, professional, and effective manner while screening and maintaining.
  • Candidates with experience in one or more of the following areas of law will be given preference: Experience with Federal Government contracts or subcontracts, including working knowledge of the FAR and agency supplements such as the DEAR and DFARs; experience with contract disputes and litigation under the Contract Disputes Act; experience with, and working knowledge of, the Freedom of Information Act and the Privacy Act and/or other federal and state privacy laws and regulations.
  • Must possess a valid driver’s license.

MSTS is required by DOE directive to conduct a pre-employment drug test and background review that includes checks of personal references, credit, law enforcement records, and employment/education verifications. Applicants offered employment with MSTS are also subject to a federal background investigation to meet the requirements for access to classified information or matter if the duties of the position require a DOE security clearance. Substance abuse or illegal drug use, falsification of information, criminal activity, serious misconduct or other indicators of untrustworthiness can cause a clearance to be denied or terminated by DOE, resulting in the inability to perform the duties assigned and subsequent termination of employment. In addition, Applicants for employment must be able to obtain and maintain a DOE Q-level security clearance, which requires U.S. citizenship, at least 18 years of age. Reference DOE Order 472.2, “Personnel Security”. If you hold more than one citizenship (i.e., of the U.S. and another country), your ability to obtain a security clearance may be impacted.

Department of Energy Q Clearance (position will be cleared to this level). Reviews and tests for the absence of any illegal drug as defined in 10 CFR Part 707.4, “Workplace Substance Abuse Programs at DOE Sites,” will be conducted. Applicant selected will be subject to a Federal background investigation, required to participate in subsequent reinvestigations, and must meet the eligibility requirements for access to classified matter. Successful completion of a counterintelligence evaluation, which may include a counterintelligence-scope polygraph examination, may also be required. Reference 10 CFR Part 709, “Counterintelligence Evaluation Program.”

Annual salary range for this position is Legal Counsel I: $92,100.00 – $111,633.60 ;Legal Counsel II: $111,633.60- $170,248.80.

Starting salary is determined based on the position market value, the individual candidate education and experience and internal equity.
