Purpose

~ This position provides support, and training as necessary, in eDiscovery implementation and management for all litigation, investigation, and regulatory matters in the Legal Department, including class action, intellectual property, franchise, product liability, warranty, employment, general commercial litigation, and government investigations. This position also provides support to the Company’s Executive Director, Class Action and Intellectual Property, in the Discovery and Electronic Discovery (eDiscovery). The individual manages workflows for defensible electronic discovery and investigations of the company’s documents and advises attorneys on best practices for eDiscovery.

~ This position is also responsible for assisting in preparing discovery responses and coordinating the collection and production of responsive materials from both within HMA and HMC. In addition, this position provide assistance to engineers in connection with document and data searches for NHTSA and other regulatory inquiries and investigations. It also coordinates and provides assistance in the management and defense of class action, intellectual property, product liability, and/or warranty cases nationwide.

Major Responsibilities

~ Provide assistance in connection with the defensible electronic forensic investigations.

~ Manage and provide eDiscovery litigation support in Relativity, including document collection, processing, review, and production of company documents in all litigation, investigation, and regulatory matters, coordinate with vendors and outside counsel on complex matters.

~ Manage and train paralegal professionals in the performance of their eDiscovery duties in litigation matters.

~ Conduct all custodian collections required for litigation, including from all company sources; processing and loading same into document review databases as needed.

~ Maintain and update pattern litigation document repository.

~ Advise attorneys on ESI protocols.

~ Coordinate and review requests for documents and information to HMC, and review HMC responses.

~ Prepare documents for discovery production in litigated matters.

~ Develop, implement, and manage HMA’s legal hold policies and procedures.

~ Prepare detailed draft responses to discovery requests including interrogatories, requests for production of documents and requests for admissions.

~ Ensure compliance with Records Management Program policies.

~ Conduct legal and investigative research as required.

~ Supervise and train temporary/contract paralegals and attorneys on special projects.

~ Negotiate special rates from outside vendors. Select/terminate and manage vendors in conjunction with Purchasing Department.

~ Collaborate with Records Management program and eDiscovery to ensure compliance with federal and state laws and regulations.

Authority

~ Manage vendors including vendors and outside law firms (define scope and ensure deliver of goods/services, monitor and drive performance, work to raise level of program effectiveness) Select/terminate and manage vendors in conjunction with Purchasing department.

~ Support various HMA departments through obtaining feedback and suggestions for program improvements, and considering what changes are feasible and appropriate.

~ Position may be involved with interviewing/evaluation of new hires.

Education

~ Must be a high school graduate
~ Bachelor’s degree preferred

Related Experience

~ Six or more years of in-house or law firm litigation experience required.

Skills/Knowledge

~ Strong drafting and negotiating skills.

~ Computer literate.

~ Careful attention to detail; capacity to handle multiple matters simultaneously.

~ Experience managing EnCase eDiscovery and Relativity.

~ Strong Access and Excel knowledge.

Certification Required

~ Paralegal Certificate required.
