Pay Range
$215,000 – $240,000 Annually
Please note that the pay range information is a general guideline only. Many factors are taken into consideration when setting starting pay including education, experience, the external labor market, and internal equity.
Job Description
We’re looking for a licensed patent attorney to join the Office of General Counsel and be a part of Lawrence Livermore National Laboratory’s important and exciting scientific and national security mission. You will be responsible for managing the filing and prosecution of patent applications, and for providing legal advice to Laboratory management and staff regarding intellectual property law generally.
The position requires subject matter proficiency in one or more of the following fields: biology; optics, lasers, physics, computer science; chemistry and materials; mechanical, chemical, or electrical engineering.
You will
- Identify and evaluate inventions, conduct patent searches and draft opinions relating to patent validity/infringement/non-infringement and other evaluations of technology. Participate on invention disclosure review boards and advise the Laboratory’s technology transfer office on patentability and other considerations in determining whether to pursue a patent.
- Prepare personally and prosecute US applications based upon Laboratory inventions before the US Patent and Trademark Office and foreign patent applications before other countries’ patent offices, as needed, in a variety of technical fields. Manage and supervise the work of outside patent counsel – who prepare and prosecute the bulk of patent applications filed on behalf of the Laboratory – and provide support for other activities and initiatives related to the practice of intellectual property law.
- Serve as a knowledge leader related to intellectual property law and practices, provide input to management on policy changes, and provide strategic IP counseling to Laboratory management and staff on complex, diverse, and multi-faceted aspects of intellectual property law, including in the context of litigation. Such work may require supporting other attorneys in reviewing contracts and related documents, drafting policies and procedures, and providing intellectual property advice, including support for licensing and other technology transfer activities.
- Participate on or assume a leadership role on multi-disciplinary teams charged with addressing legal or business matters that are diverse and multi-faceted in scope that may potentially have a significant financial or reputational impact on Laboratory programs or operations.
- Interpret and apply federal and state laws and regulations, contract provisions, government orders, etc. as they apply to the Laboratory in the areas of intellectual property.
- Perform other duties as assigned.
Qualifications
- Ability to secure and maintain a U.S. DOE Q-level clearance, which requires U.S. Citizenship.
- Bachelor’s degree in a technical field or equivalent combination of education and related work experience. Juris doctorate degree. Admission to practice before the U.S. Patent and Trademark Office and either admission to practice in California or eligibility for a limited practice license as registered in-house counsel.
- Substantial experience in drafting and prosecuting US and foreign patent applications in some or all of the following fields: optics, lasers, physics, computer sciences; chemistry and materials; biology; mechanical chemical and electrical engineering.
- Comprehensive knowledge and understanding of patent and other intellectual property law, proceedings before the USPTO, and the practice of intellectual property law generally.
- Significant experience in an active legal practice, with a career progression over time to positions having greater responsibility and involving matters of more complexity and/or greater significance to the client.
- Advanced analytical, writing, and presentation skills.
- Experience applying independent judgment in advising senior managers about legal and reputational risk and tradeoffs among possible courses of action.
- Ability to collaborate with other attorneys and non-attorney professionals to work as a team in accomplishing goals and solving problems collectively.
Qualifications We Desire
- Experience working as an in-house patent counsel for a business, science-based research organization, university, or government agency.
- Experience supervising or directing work activities of outside counsel and other legal professionals.
- Experience reviewing and advising in the areas of technology transfer and other agreements, intellectual property disputes and litigation, policies and procedures, copyright, trademark, trade secrets and other matters.
- Knowledge of the Federal Acquisition Regulation and laws and regulations concerning government-owned intellectual property.
