SUMMARY

Under general supervision and reporting to the Director of the Office of Equality and Civil Rights-Title IX Coordinator, conducts investigations, develops and ensures implementation of corrective actions; assists with administration of compliance with local, federal and state regulations regarding non-discrimination and equal treatment.

RESPONSIBILITIES:

  • Manages daily services associated with conducting impartial investigations of incidents, as reported to and in close collaboration with the Director of the Office of Equality and Civil Rights.
  • Investigates complaints, collaborates with district partners to manage the interim safety accommodations, and ensures that students and staff are aware of their options and resources with respect to reporting and filing complaints alleging sexual harassment, sexual assault, and sexual misconduct.
  • Facilitates informal and formal mediation processes and restorative justice approaches to resolve conflicts involving protected class status.
  • Receives confidential questions/concerns from employees, students, and community concerning compliance situations; investigates questions/concerns received by e- mail, voice-mail, external hotline, drop-ins, etc. to determine specifics and provide recommendations for resolution or refer concern to appropriate individual(s) for follow up.
  • Responds to reports of incidents alleging discrimination, bullying, sexual harassment and retaliation in a prompt and thorough manner, and when necessary conducts investigations; maintains communication with all involved parties.
  • Plans and conducts confidential investigations of incidents and complaints; identifies and conducts interviews with all involved parties, gathers and secures relevant documentation; analyzes data, compares incident reports to legal standards and policies, and develops recommendations to address and resolve issues.
  • Provides a detailed report summarizing the investigation, or findings of the investigation, in accordance with organizational policy, and when applicable, local, state, and federal rules and regulations.
  • Consults with management and employees on creating and maintaining an equal opportunity environment and the interpretation and consistent application of local, state, and federal rules, regulations and organizational policies.
  • Collaborates with HR and other departments for appropriate follow-up after report summaries and findings of investigation completed to document corrective action and resolution.
  • Develops and implements evidence-based primary prevention and educational strategies designed to reduce incidents of discrimination, bullying, sexual harassment and retaliation; assists schools with incidents and investigations of incidents of bullying under Minn. Stat. 121A.03.
  • Assists in research, design, and development of educational materials for communication trainings related to all aspects of equality and non-discrimination; identifies training needs and implements broad-based and customized training across all levels of employees and students on all relevant topics.
  • Facilitates presentations for new staff.
  • Collaborates with district and community partners on educational efforts relating to prevention of discrimination, bullying and sexual harassment
  • Develops a branding and marketing campaign to increase awareness of office services and resources; manages social media presence and website for the Office of Equality and Civil Rights.
  • Maintains visibility and accessibility to students regarding Title IX issues, sexual violence, and related programs and services.
  • Plans and conducts compliance monitoring reviews including review schedule compliance plans against established policies and procedures and applicable regulations; verifies documentation to support certified monitoring plans where applicable; develops recommendations for corrective action based on review findings.
  • Reviews a wide variety of organization policies and procedures to ensure compliance with legal, accreditation and internal standards; analyzes existing policies, identify gaps and recommend new/revised policies and procedures and approval processes.
  • Performs various administrative functions within the Office of Equality and Civil Rights; processes transactional information; performs experienced technical records management duties; performs data entry and record updates for employee tracking, records maintenance and database management.
  • Demonstrates courteous and cooperative behavior when interacting with students, clients, visitors, and organizational staff; acts in a manner that promotes a harmonious and effective workplace environment.
  • Enthusiastically promotes the Superintendent’s goals and priorities in compliance with all policies and procedures.
  • Maintains absolute confidentiality of work-related issues, records and organizational information.

MINIMUM QUALIFICATIONS

Master’s Degree in Education, Counseling, Law (Juris Doctorate), Social Work, or related field
AND
2 years of legal research and investigation experience or an equivalent combination of education, training and experience as determined by Human Resources.
Knowledge of:

  • State and Federal laws, statutes, rules, codes and regulations governing student rights, employment and civil and human rights functions, including U.S. Equal Employment Opportunity Commission (EEOC), Americans with Disability Act (ADA), Section 504 of the Rehabilitation Act, Titles VI and VII of the Civil Rights Act, Title IX of the Education Amendments of 1972, Age Discrimination in Employment Act of 1967 (ADEA).
  • Principles and techniques of developing and delivering effective training programs.
  • Practices and procedures of state and federal regulatory agencies.
  • Principles of confidential records and file management.
  • Current trends and issues impacting student populations and K-12 education.
  • Analytical skills and creative problem solving in working with a variety of individuals from various socio-economic, ethnic and cultural backgrounds, in person and over the telephone, often where relations may be confrontational or strained.
  • Techniques for conducting effective investigations and confidential interviews.

Skill in:

  • Conducting confidential investigations and interviews; researching, collecting and analyzing data, and preparing well-documented reports.
  • Providing guidance, consulting with staff, and resolving problems on internal compliance.
  • Understanding and applying the principles, concepts, procedures, laws and rules governing the operations of equality and civil rights programs in public k-12 education.
  • Communicating and interacting effectively with individuals and groups of diverse economic, racial and ethnic backgrounds, gender identities, sexual orientations and physical/mental abilities
  • Working with individuals involved in sexual misconduct and intimate partner violence complaints (complainants, respondents, witnesses, etc.) Experience and/or training in forms of conflict resolution including conflict coaching, mediation, facilitated dialogues, and restorative justice
  • Written, verbal, and interpersonal communication skills sufficient to successfully interact with students, large groups, teachers, staff, law enforcement, family members, the public, and other professionals
  • Effectively managing highly confidential and sensitive matters.
  • Operating a personal computer utilizing standard and specialized software.

LICENSE AND CERTIFICATION REQUIREMENTS

A valid Minnesota State Driver’s License may be required.

PHYSICAL DEMANDS AND WORKING ENVIRONMENT

Work is performed in a standard office environment which requires occasionally lifting such articles as file boxes or heavier materials with help from others and/or lifting and carrying light objects frequently. A job in this category may require walking or standing to a significant degree or may involve sitting most of the time with long periods of computer work and heavy phone usage.
