Our Organization and Mission:The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.

Pay: $100,000 annually

Position Summary: This position is in the Civil Legal Services – Revenue Litigation Division. The primary duty of the position is to represent the State of Florida, Department of Revenue, as well as other state agencies, in litigation in Federal and State courts and in the Division of Administrative Hearings. The majority of cases consist of tax matters involving statutory interpretation and constitutional issues. The attorney may be assigned to cases both at the trial and appellate levels. At the trial level, the cases may be before a judge, a jury, or an administrative hearing officer and before the Governor and Cabinet.

Qualifications: Admission to the Florida Bar and six years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

The Work You Will Do:

The duties of this position may include but are not limited to:

  • Research and draft answers, motions, interrogatories, memoranda, briefs, orders and other pleadings and documents, together with opinions of this office.
  • Attend trials, hearings, and appellate oral arguments. The attorney will also prepare witnesses for depositions and trial, attend depositions, documents review and perform other discovery. Only after gaining experience in the field will the attorney be lead counsel in a case.
  • Acquire expertise in the area of tax litigation, including reading judicial decisions and case summaries and from any other appropriate source. The attorney is expected to acquire litigation skills and require less and less direct supervision. Also, the attorney may be required to participate in short-term projects involving legal duties of this office in the representation of the State.
  • Perform routine administrative matters, including supervising attorneys, legal secretaries, paralegals, and interns; attending section staff meetings; preparing travel vouchers, time records and case status reports; filing documents, etc. Assist and advise junior attorneys in trial, pleading, practice, procedures, etc. As needed, process performance reviews, hiring packages, and other routine personnel related documents and processes. Respond to inquiries from the public.
  • Maintain current expertise in areas of practice, including reading recent judicial decisions and case summaries and attending continuing legal education and other professional seminars.

The position requires travel as the Tallahassee office represents the Department of Revenue and other agencies in every court in Florida.

Preference will be given to candidates with verified civil litigation or appellate experience and excellent writing skills. Business or accounting experience desirable but not required.
