SALARY RANGE: $124,365 – $163,242

LOCATION: 2 Broadway New York, NY 10004

HOURS OF WORK: 9:00 am – 5:30 pm (7 1/2 hours/day)

This position will provide support to the Deputy General Counsel/Unit Chief and will handle litigation in federal and state courts on behalf of the MTA involving commercial, labor, employment, real estate, torts, administrative, intellectual property, and civil rights/constitutional law, among other areas.

This is a senior level counsel who has a very high level of expertise in litigation. The individual has extensive knowledge of Federal, State and Local laws, and is abreast of the latest court decisions and how they may impact litigation. This is a position where senior management may refer to for legal guidance, as well as a wide variety of middle level management with the MTA.

Responsibilities

  • The incumbent will provide legal advice and counsel on the more complex and complicated matters pertaining to litigation. This will include recommendations on policy, procedures, and general legal matters as well as advise on litigation matters.
  • The incumbent will be pro-active advising appropriate parties of changes in the law, interpretations, and recent court rulings which may impact litigation involved with (i.e. Environment, Real Estate etc.)
  • The incumbent will handle in-depth investigations that pertain to litigation and do a full analysis and recommendation, including presentations to senior management on the findings.
  • The incumbent will assist the agencies in legal matters and present a coordinated effort on matters related to litigation.
  • The incumbent will review the direction of various MTA projects and identify any areas of concern from a legal perspective.
  • The incumbent may coach and counsel less experienced attorneys at the MTA.
  • The incumbent will assist in the business goals of the MTA Legal Dept. in whatever manner as required by the General Counsel.
  • The incumbent is responsible for direct handling of litigation matters and supervision of in-house attorneys and paralegals, as well as outside counsel, including pleadings, pre-trial motions, client interviews, discovery, trials, settlement negotiations, and appeals.
  • The incumbent supports the General Counsel in providing legal advice and counsel on such matters as federal and state regulatory compliance, ethics, Freedom of Information Law requests, corporate governance, and legislation.
  • The incumbent assists in the preparation of internal and external litigation reports.
  • The incumbent performs other duties as assigned by senior management.

Knowledge, Skills, and Abilities
The incumbent is required to have strong communication skills, both oral and written. The incumbent needs to be able to prioritize projects and to be open to suggestions and ideas. The incumbent must be able to build and develop client relationships and must have strong work habits. He or she will often have to work under pressure and deadlines and is expected to come up with solutions to legal issues to help the MTA and MTA agency clients.

  • Education & Experience
    Juris Doctor Degree from an accredited law school and New York State Bar Admission and license to practice law, maintained in good standing throughout employment. Admission to the U.S. District Courts for the Eastern and Southern Districts of New York is preferred. Excellent academic credentials.
  • In addition, a minimum of 8 years of legal experience involving general litigation or corporate and transactional matters is required.
  • Experience in federal and state court litigation and negotiating settlements. Experience with Article 78 proceedings is desirable.
