Senior Compliance and Investigative Analyst

The Comptroller’s Bureau of Contract Administration (BCA), in accordance with the NYC Charter, is responsible for reviewing all contract actions including, but not limited to, contracts, contract amendments, leases and concessions entered into between City agencies and vendors to determine whether the particular actions should be registered. Under the general supervision of the Senior Advisor and Counsel to the Deputy Comptroller for Contracts and Procurement, the Senior Compliance and Investigative Analyst (Senior Analyst) will perform confidential vendor research of greater than ordinary difficulty tied to vendor integrity and financial issues. The Senior Analyst will utilize this research to develop strategies and protocols, and compile data and information pertaining to background and contract compliance investigations on both prime vendors and subcontractors.

Additionally, the Senior Analyst will perform monitoring and analysis of service and commodity contracts to identify programmatic and financial issues or discrepancies, including but not limited to instances of overbilling, double-billing and inadequate controls. The Senior Analyst will prepare reports to refer matters via memoranda to the appropriate authorities, such as internal Comptroller Bureaus, the New York City Law Department, the New York City Department of Investigation, Office of the Special Commissioner of Investigation for the New York City School District (SCI), and other law enforcement or oversight agencies, as required. Other duties and responsibilities include, but are not limited to:
• Researching and reviewing contracts, vendor disclosures/filings and background checks, rules, regulations, policies, and procedures to determine vendor integrity or contract compliance concerns or if further legal review is required;
• Recommending revisions to applicable statutes, regulations, rules, policies, and procedures related to findings;
• Negotiating and recommending resolution of complex contract compliance matters, including vendor reimbursement of funds received through erroneous billing and other corrective actions;
• Preparing memoranda and reports containing information collected from reviews;
• Reviewing and maintaining files of vendor procurement protests, agency determinations of non-responsiveness and non-responsibility as well as vendor appeals of same and final agency head determinations;
• Listening and documenting notes from contract public hearings, including those administered by the New York City Mayor’s Office of Contract Services, City Council and the New York City Department of Education’s Panel for Educational Policy;
• Reviewing various sources including daily Press Clips, New York City Record Online, PASSPort Public and CheckbookNYC to identify vendor integrity issues and procurements of concern relating to active City contracts, or those pending registration with the Bureau of Contract Administration;
• Making recommendations and generating complex correspondence regarding:
o vendor responsibility/non-responsibility determinations in connection with contract awards, contract modifications, emergency purchases and extensions, as required;
o breaches of contract and terminations of contracts for cause, as required; and,
o investigative reports received from SCI regarding vendors, their principal owners/ officers and employees.
• Perform other related duties and assignments as assigned.

QUALIFICATION REQUIREMENTS / PREFERRED SKILLS:

1. A baccalaureate degree from an accredited college and three (3) or more years of satisfactory full-time professional experience in procurement/contract analysis and review, investigations to identify or gather evidence of criminal activity or fraud, research and evaluation, economic analysis or financial administration, or fiscal, and/or economic research, or in a related area; preferably, performing functions similar to the bulleted list of job duties mentioned above; or,

2. Education and/or experience equivalent to 1 above.

Minimum Qual Requirements

1. A baccalaureate degree from an accredited college; or
2. A four-year high school diploma or its educational equivalent and four years of full-time experience in budgetary planning, financial analysis, management or engineering.

Preferred Skills
• Investigative experience performing fraud/financial investigations, research, compilation and/or location of evidence or information in order to uncover activities of an unlawful nature;
• Working knowledge of City policies, procedures and agencies, including contract administration, negotiation and purchasing requirements;
• Prior research experience/exposure related to IT procurement systems is preferred;
• Comfort working with a variety of data sources and technologies (familiarity with NYC Systems including PASSPort, FMS, Crystal Reporting, and OAISIS preferred);
• Ability to work effectively in a fast-paced environment while managing multiple priorities and looking ahead to manage deliverables;
• Excellent interpersonal, communication, and organizational skills (including Microsoft Office Suite proficiency).
