Department Overview

TD’s Global Labor and Employment Team is comprised of a select group of experienced and collaborative labor and employment law specialists supporting all facets of TD’s business throughout its global footprint. With lawyers currently located in New Jersey, New York and Toronto, the Team provides guidance to management and human resources professionals on a broad range of issues arising in the financial services industry. Key topics for this role include employee relations; performance management; discipline and discharge; internal investigations; leaves of absence; accommodations; wage and hour; EEO; diversity; separation and severance; employee benefits; incentive and executive compensation; government contracting; due diligence; and general compliance with all local, state and federal labor and employment laws within the Bank’s U.S. footprint.

Job Details

The Senior Employment Counsel reports to the Head of the Global Labor & Employment Legal Team and is responsible for partnering with U.S. human resources, business leaders, control and risk management functions, and Legal colleagues to ensure that employment and labor risks and compliance are properly understood, considered, and addressed in the decision-making process. The Senior Counsel will also partner with human resources to provide effective and practical strategies to address and resolve complex labor and employment issues, as well as assist with the development of policies and practices necessary to mitigate related employment risks. In addition, this role will represent TD in the Bank’s efforts to informally resolve threatened legal disputes and manage outside counsel in the defense of state and federal administrative claims and litigation.

Job Requirements

  • Must be eligible for employment under regulatory standards applicable to the position.
  • May manage paralegal and administrative staff, assigning responsibilities and evaluating results
  • Provides leadership, coaching, counseling and guidance to staff
  • Supervises external counsel providing advice or other legal services of the Company
  • Works closely with General Counsel, department attorneys and external legal counsel on specific legal issues related to the Company’s business
  • Gives practical support and assistance to contemporaries, junior attorneys and staff
  • Volunteers expert advice and experience
  • Verifies the information has been understood
  • Serves in one or more permanent or ad hoc practice groups or cross-practice teams of attorneys and staff
  • Assists in the management of expenditures for external counsel
  • Advises lines of business on best practices that help minimize legal and litigation risk
  • May assist General Counsel in developing and managing departmental budget for both internal and external legal spend
  • Anticipates client needs
  • Deals with complex legal issues
  • Clearly delivers difficult messages without jeopardizing client relationships
  • Gives pragmatic legal opinions with reasons and rationale
  • Provides advice in ambiguous situations; identifies and prevents future legal risks
  • Identifies and takes action on future opportunities
  • Resolves most situations where conflicts arise between the needs and desires of specific business units and the interests of the Company without requiring intervention of more senior attorneys
  • Demonstrates highest professional ethical and behavioral standards and complies with all applicable Bar Rules and Codes of Professional Responsibility, and corporate ethical and behavioral standards
  • Participates in special projects and performs additional duties as required
  • Qualifications

  • Bachelors degree required
  • J.D. from an Accredited Law School required
  • 10+ Years of related experience
  • Strong knowledge of at least one area of law relating to banking/financial services operations and issues
  • Integrity and high moral standards

  • *Preferred Qualifications*

  • Labor and employment law experience preferred
  • Ability to work independently on multiple projects managing various deadlines preferred
  • Ability to cultivate and maintain strong relationships with business/HR preferred
  • Interest in a high level of business/HR engagement and interaction preferred
  • Experience counseling human resources and business professionals preferred
  • Exposure to the financial industry and/or multi-national/multi-jurisdictional corporations is a plus
