Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.
Pay: $58,000 – $61,000 annually, commensurate with experience.
Position Summary: The Florida Office of the Attorney General is seeking a highly talented, self-motivated, investigative, and analytical minded team member to investigative matters assigned to the Consumer Protection Division. The selected candidate will investigate suspected civil and criminal violations and be in a position to advise and assist on referrals to Florida Department of Law Enforcement and other agencies. The investigator will develop partnerships with other agencies relating to consumer protection crimes and civil violations, establish lines of communication with local, state, and federal law enforcement and other enforcement agencies as appropriate.
This critical, Orlando, Florida based component of our investigative responsibilities necessitates a candidate’s ability to perform the major portion of the duties assigned with a minimum amount of supervision.
Qualifications: A bachelor’s degree from an accredited college or university and five years of investigative or law enforcement experience conducting criminal, civil, or administrative investigations or examinations, which must include a minimum of two years of experience with financial investigations, financial examinations or analysis or other related financial investigative experience, or complex organized crime or RICO investigative experience. A master’s degree in a related field from an accredited college or university may substitute for one year of the required experience. Experience in fraud, RICO, or white-collar investigations; financial investigations, examinations or analysis; or law enforcement may substitute on a year-for-year basis for the required education.
Preference will be given to applicants:
- Certified Fraud Examiner (CFE) certification through the Association of Certified Fraud Examiners (ACFE).
- Bachelor’s Degree in Criminal Justice, Finance, Accounting, Business, or a related subject.
- Experience conducting investigations related to fraud and financial crimes, in furtherance of civil and/or criminal court actions.
- Experience as lead investigator in support of civil litigation, including the preparation of professional memoranda of findings, charts, graphs, spreadsheets, or other means of representing the discovered facts and evidence.
- Experience in the use of Social Media Intelligence (SOCMINT), Open-Source Intelligence (OSINT), and other internet resources to identify individuals, links between organizations, determine size and composition of businesses, and identify assets for forfeiture. Experience conducting online and web-based investigations, web captures and performing controlled purchases online.
- Experience analyzing financial records of businesses, bank records, tax returns and financial statements.
- Experience testifying in state or federal courtroom proceedings.
The Work You Will Do:
The duties and responsibilities of this position stem from enforcement of Chapters 501, 542, 812, 817, 895, and 932 of the Florida Statutes, and related laws and administrative rules of the state, and other federal statutes, rules, and laws.
The selected candidate will provide investigative support and assistance to the Bureau Chief and attorneys, including but not limited to the following duties:
- Review and evaluate consumer complaints to determine if a violation of Florida law exists.
- Conduct financial investigations in consumer protection cases, including, but not limited to unfair and deceptive trade practices, antitrust, RICO, consumer fraud, asset forfeiture, organized fraud, theft, and organized schemes to defraud.
- Locate and identify concealed profits in trusts, domestic and foreign corporations, banking institutions, real and personal property and any other method or means of concealment.
- Asset tracing of profits received from unlawful activities through all financial conduits.
- Utilize computers and the internet to develop leads utilizing Social Media intelligence (SOCMINT) and Open-Source Intelligence (OSINT) techniques to further investigations. This will include capturing digital evidence during your research and compiling it in an acceptable format to be presented as evidence during litigation.
- Prepare investigative reports and memos.
- Present investigative case status briefings to attorneys and discuss investigative strategy with attorneys.
- Review affidavits and help prepare for the examination of witnesses. Attend depositions, take sworn statements, administer oaths, and interview witnesses.
- Input and maintain data in Excel and other databases to analyze trends and develop investigative leads.
- Liaise with other law enforcement and regulatory agencies to develop investigative leads or to respond to requests for information.
- Prepare documents, exhibits, schedules, reports, and other pertinent information for use in cases litigated in civil courts of law.
- Testify in court hearings, trials, and depositions regarding investigations for which they conducted.
- Assist in enforcing Florida’s Price Gouging Statute during declared States of Emergency. This will include the need to review and evaluate consumer complaints to determine if a potential violation of Florida price gouging law exists. Conduct site visits and contact businesses to evaluate allegations of price gouging. Assist with negotiating a resolution of the initial complaint. Serve preservation letters and/or investigative subpoenas. Obtain documents related to business pricing, then analyze and provide findings and recommendations determining whether a price appears unconscionable. Price Gouging enforcement will require working extended hours, working on weekends and may require working on holidays during a declared State of Emergency.
- Act as a lead investigator for the Orlando office to directly assist the Investigator Supervisor with all general consumer protection investigations.
- Act as mentor and assist with training of newer investigators and junior level investigative staff.
- Assist attorneys with special assignments, which may require extended hours and/or travel outside the worksite.
- Perform other related work as required.
