Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.
Pay: $120,000 annually
Position Summary: This position is in the Civil Litigation – Complex Litigation Division. This position is responsible for litigating the most sensitive and highly complex civil cases- those involving the Attorney General, the Governor and other Cabinet members, the legislature, state agencies, and the judiciary. The matters at issue in these cases frequently have statewide impact, represent significant monetary exposure and influence the policy direction of state government. The cases frequently involve extraordinary writs, class actions, preliminary injunctions and emergencies regarding matters of great public importance where response time is minimal and demands are great. Primary expertise in issues involving complex litigation and representation is required.
Qualifications: Admission to the Florida Bar and ten years of professional experience in the practice of law, in the judiciary or in teaching law or any combination thereof; and five of the ten years must be in the specialty area in which the attorney is being hired.
Preference will be given to candidates with:
- Substantial jury or bench trial experience.
The Work You Will Do:
The position prosecutes and defends civil litigation on behalf of state agencies and officials in all federal and state, trial, administrative and appellate courts, as requested and as provided by law. The duties include researching and drafting motions, answers, replies, memoranda, briefs, opinions, orders and other miscellaneous pleadings and documents. Significant familiarity with standard office software as well as online research databases is required. Additional requirements include conducting investigations and involvement in all aspects of discovery, including use of e-discovery management and review applications. This position handles settlement negotiations, pleadings, pre-trial proceedings, jury and non-jury trials, administrative hearings, post-trial proceedings and appellate practice. The Special Counsel exercises a thorough working knowledge of federal and state rules of civil procedure, evidence and substantive law. The position requires the ability to research and work independently and involves travel in and out of the state. The Special Counsel may also be required to participate in the drafting of amicus briefs for filing at all levels of state and federal courts. The incumbent must also maintain current expertise in areas of practice, including reading recent judicial decisions and case summaries and attending continuing legal education and other professional seminars.
