NYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (G-25); OR a NYS employee with one year or more of permanent or contingent-permanent competitive service in a title at Grade 23or above with current NYS Bar Admission and eligible for transfer to Senior Attorney under Sections 70.1, 70.4, or 52.6 of the Civil Service Law. (Candidates requesting consideration for transfer must also be a graduate of an accredited law school with a LLB or JD degree, and may also need to meet additional experiential conditions to qualify for consideration.)
Preferred Qualifications: The preferred candidate will have strong legal skills, impeccable judgment and excellent speaking, writing and research skills as well as familiarity with: the federal Patient Protection and Affordable Care Act, Medicaid, other public health insurance; drafting and negotiating contracts; immigration law. Preferred experience will have included providing legal analysis of insurance and/or public health law and/or federal health care laws.
Duties Description The incumbent will report to the Director of the Office of the Marketplace Counsel and will be responsible for providing legal analysis and research on matters related to NY State of Health (NYSOH). Duties include, but are not limited to: participating in meetings, workgroups, and committees on behalf of the Director; drafting or commenting on legislation and regulations related to the Marketplace; researching and interpreting applicable federal and state laws, rules and regulations including but not limited to, public health, insurance, finance, tax, administrative procedure and social services and federal health care laws; reviewing legal papers served or received to determine appropriate responsive action; advising program of appeals and litigation commenced and development in existing appeals and litigation and determine agency position on issues raised by legal papers; drafting legal documents needed to operate the NYSOH Marketplace including memoranda of understanding with state agencies and other third parties and procurement contract documents; providing legal advice to Marketplace staff in support of the operation of the Marketplace including but not limited to issues related to the Small Business Marketplace; drafting and editing Marketplace materials for the public; preparing briefs and legal papers; performing necessary legal research and rendering opinions on questions of law; conferring with the Department of Health’s Office of Health Insurance Programs and with program staff on legal issues that may arise in the operation of the Marketplace that have a direct or indirect impact on insurance affordability programs; preparing memoranda to Marketplace staff on changes in law or regulations that effect the Marketplace; conferring and corresponding with outside agencies on questions of law and procedure.
